The following is a series of exchanges on a comment thread at Protein Wisdom between myself and a Llama School. As it happens, it turned into an interesting Socratic discussion of the Iraq War, which I’ve opted to repost.

I don’t know if the President lied, or misled, or was misled. I can’t judge that, and I won’t be chanting “Bush lied, people died”. Though the alternative ("The Bush administration was incompetent, took shaky “evidence” without properly examining the alternatives, and because of this went to war under mistaken pretenses; people died") isn’t much better.

Fair enough. Now just a little food for thought about the role of the intelligence community in the diplomatic and security arenas:

I’ll stop there before I get to the lucky 13. But the point being is that this President has acted as reasonably and carefully on intelligence reliable as any President historically. Not a lot of out line on that front, when it comes down to cases.

Let’s take your logic here (for now, putting aside your statement that the President acted reasonably and carefully on this intelligence). If the intelligence community is this bad, then why on earth should a President start a preemptive war based on such a flawed institution?

Ok, here we go…

Once upon a time, the dynamics governing state-to-state interactions and terrorism were basically understood to have self-limiting elements. Deterrence, in all of it’s lovely forms, among them. The interplay of deterrence and political effectiveness between interstate relations and terrorism basically dictated (according to the logic of the day) that there was an upper bound to the amount of damage and fatalities that terrorists would seek. Think of the self-imposed IRA ban on attacks on the royalty.

Ok, so then along comes 9/11, demonstrating rather visibly that this self-limiting factor was no longer applicable. From now on, we could not rely on the restraint of intent by latent threat. To put it more simply, it became apparent that these guys were really quite serious about killing as many infidels in as spectacular a fashion as possible.

Now, check this - we have an intelligence apparatus that is mighty, mighty, far from foolproof. Moreover, our laws have many features that mean that ensuring the kind of domestic controls that could prevent an attack - in other words adequate defense - would be impossible.

So… we can’t accurately keep tabs on WMD development.

So… we can’t reliably count on stopping terrorists every time they try for a mass casualty attack.

So… we can’t make particularly good predictions about the leadership and future behavior of rogue states.

So… we have a great deal of difficulty tracking and monitoring relationships on the ground in a wide variety of instances.

Now, let us suppose that Al Qaeda is serious when they say acquiring nuclear weapons is a holy duty. Furthermore, let us take Al Qaeda seriously when they announce the fact that they consider anyone who pays taxes and thereby contributes to US government revenue to be someone eligible for murder at their hands.

So, what happens if they are able to make good on their intentions. And what makes you think for a single instant that we’ll find out about it before the attack Every Single Time?

I don’t think I’m alone in feeling that war is the lesser of two evils here. And that’s not the same thing as saying the evil we got is great, it’s just saying the downside potential of inaction is far more significant.

And secondly, there was dissent within the intelligence community re: the view that Hussein had what some claimed he had. So this wasn’t necessarily a failure of the intelligence community...it was a failure of someone to listen to all of the voices in the intelligence community before acting. This wasn’t an example of the intel community giving a clear, unambiguous sign that Hussein had stockpiles of WMDs. The intelligence community was torn, the evidence was questionable, and someone in the administration decide to damn the torpedoes and go ahead based on what ended up being very very wrong.

I was trying for more of a descriptive process, but what the heck, we’ll take it as prescriptive. I think that of the many nations in the War on Terror that need to be addressed, the Axis of Evil represented the three most significant short to medium term threats. Clearly, taking all three out was not much of an option for what are, essentially, political reasons. Furthermore, from a legal and diplomatic standpoint, Iraq was by far and away the low hanging fruit of the bunch. Think about it, with all this stink after violation of the Gulf War cease-fire, 17 UN Resolutions, the Iraq Liberation Act, and the Authorization for Use of Force, there’s still this amount of rancor. Other countries may have been more fruitful targets, but the political ruckus would have been unimaginable.

But, in general, I put the above description to you as an implied question - so what would you suggest?

Secondly, I am not sure that “dissent within the intelligence community” means what you think it means. Actually, as far as it goes, I’m pretty certain. There really isn’t and has never been a way for an analyst writing a report to say, “Well, I’m pretty darned certain about A, provided that B and C are true - if not, A is never going to happen.” Rather the analyst will write something along the lines of “There are strong indicators that A will occur, based on information from B and C.”

Now this isn’t a matter of shirking or anything else, it’s a lot more to do with the fact that fully qualified reports start to lose utility. A decision maker will go over material, provided it’s brief. A staffer will advocate a policy, based on what they actually read. If the analysis becomes too cumbersome, it just gets skipped because people are freakishly busy.

So, when you talk about “dissent within the community”, that’s not really saying a whole lot. Of course analysts disagree about things. Of course these concerns aren’t always borne out in excruciating detail. That’s just the way intel works (and incidentally is the reason that the US has a preference for technological, rather than human intel).

Second, the much bandied about claim of “dissent” comes from the notion that of the 16 agencies in the US Intelligence Community, all of them were in agreement that Hussein had retained chemical and biological materials proscribed by UN Resolutions. Of the agencies that maintained that he possessed nuclear materials in defiance of UN Resolutions, there was one, just one, agency that was of the opinion that he was not in violation of agreements on nuclear weapons programs.

For the sake of brevity, I’m not going to pass on open and closed source intelligence from non-USG sources, despite the fact that there are some truly interesting things on that front.

At any rate, let’s take the tally here, 16 agencies: Yes on Chemical Weapons Programs, Yes on Biological Weapons Programs, 15 Yes on Nuclear Weapons Programs, and 1 No on Nuclear Weapons Programs. That’s our dissent.

Now, to define our terms here (and I’m just going to skip compliance with the rest of the provisions of UN 1441 for the sake of simplicity here):

"Deploring the fact that Iraq has not provided an accurate, full, final, and complete disclosure, as required by resolution 687 (1991), of all aspects of its programmes to develop weapons of mass destruction and ballistic missiles with a range greater than one hundred and fifty kilometres, and of all holdings of such weapons, their components and production facilities and locations, as well as all other nuclear programmes, including any which it claims are for purposes not related to nuclear-weapons-usable material,"

Ok, so now that we’ve set the stage, what actually happened?

Let’s start with the nukes - as it turns out, the agencies were incorrect on compliance with the resolution on nuclear programs. Iraq was in violation, so the dissenting agency here was in the wrong.

Well, what about chemical and biological materials? Well, I’m not going to rehash the Kay Report, but on a fundamental, brass-tacks level, Iraq was in violation of the WMD provisions of 1441.

Period.

This then presents a few obvious questions:

1) Why all the hue and cry about not finding WMD?
2) Did discovery of these materials then justify the war?

On the first question - you have to recall that the administration itself didn’t rely heavily on WMD. Perversely enough, more dovish legislators who made the calculation that failure to back the war would make them seem soft on defense issues then had to pitch the conflict to the relatively dovish constituencies they represented. Being dovish and very vocally in the “war as last resort” camp, the pitch had to be a much spookier hard sell of the argument I gave earlier. This almost inevitably got rephrased and dumbed down to “Saddam will give Al Qaeda nukes which they’ll use in the US” which is a gross misstatement of the argument and a disastrous oversimplification.

In other words, in order to make the more difficult pitch, they started (not unreasonably) placing bets on finding a very dramatic smoking gun. Which, evidently, didn’t show up on cue.

On to the second point, was the war justified based on the discovery of violations of UN 1441? Tough call - it depends on how you call the justification. As far as it goes, Iraq had been in violation of the Gulf War Cease Fire for years and years, which in and of itself is legal grounds for full resumption of hostilities.

But this is kind of beside the point. The short answer is that the discovery of weapons is a backhanded justification. Not because some guy had a centrifuge - while legally passable, I sure as hell wouldn’t drop a cool $100 billion and send home 2,300 “We Regret to Inform You“ letters over that.

But this is where the more troublesome chunk of the earlier analysis comes in. We (the US and others) were absolutely convinced that the WMD was a slam dunk. And you know what? Even three years on, with complete and total access to everything in the country, we still don’t have any real answers. Do you recall the recently aired tape about the Iraqi guys spouting off about their weapons and concealment programs? One of the rather disturbing things, from an intel point of view, was that one of the speakers on the tape is unidentified.

Think about that - after 12 years of inspections, after 3 more years of having full and total access to anyone and anything in the country, we’re still finding out about people at the highest levels who were intimately involved in the WMD programs. That doesn’t speak highly to our actual understanding of what was - or is - going on.

So to make a complex answer long, the uncertainty of our intel forecasts is even worse than we had thought. Moreover, by pure grace alone, it turned out that the error turned out to be a false positive. If we had a false negative - decided that Iraq had disarmed when they really hadn’t, we wouldn’t know about it until the nuke gets displayed. If we had a true positive on WMD, then people not too dissimilar from yourself would be crowing about how they knew Iraq had chemical weapons and then Bush had to invade and provoke Iraq anyways when diplomatic measures were working. They’d probably go on to say that he’s a reckless unilateralist who should have listened to his allies, but now Americans are coming home dead because he’s a brash simpleton. The bad part of that scenario is that the body count would be higher than it turned out to be, for both Americans and Iraqis.

To rephrase, I would have to say the course of action Bush pursued with respect to Iraq was the least miserable of all choices available to him at the time. I also think that the strident opposition leveled at Bush is going to make the next decision maker understandably gunshy about using force. Furthermore, I am convinced that this increasing hesitancy will ultimately (sooner or later) result in the death of thousands and thousands of Americans that otherwise need not have died, because we won't be aggressive, and we'll fail to stop Every Single Attempt at a WMD terrorist attack.

Thanks for the reply. As for Iraq, they were the low-hanging fruit of the Axis of Evil, yes. But because they can be attacked...they should be attacked? Why, when their WMD program can be neutralized by inspections, or when they are at best tangentially related to Islamic terrorism?

As for me, I would suggest attacking Afghanistan, and police action as a better way of combating terrorism than taking over a nation-state barely related to Islamic terror, letting simple services in the country break down, letting it be unsafe for any Westerner to walk without fearing abduction (which, by the way, wasn’t the case before), etc. etc.

To elaborate, I stand by my comment that there was serious dissent in the intelligence community, and that the October 2002 NIE was NOT reflective of what the intelligence community had believed in previous reporting. For example, see this excerpt (and your filter thinks that US News dot com is "questionable content", so I can't provide a link):

What has been lost in this recent round of finger-pointing is just how much dissent there was inside the intelligence community. Perhaps the most pivotal document was the National Intelligence Estimate on Iraq's weapons in October 2002. The report, produced in record time, was significantly more conclusive than previous assessments, asserting that Saddam possessed chemical and biological weapons and had probably resumed building nuclear weapons. But the shifts weren't based on new data. "The intelligence community, for the most part, talked about estimates and judgments, rather than solid evidence," says Greg Thielmann, who retired as acting director of the nonproliferation office in the State Department's Intelligence and Research Bureau as the NIE was being drafted. That office and the Energy Department, in fact, vigorously disputed the NIE's conclusion that Iraq had restarted its nuclear program. Ok,

A couple of points there are worth tackling, so I am going to do this in reverse order. (Sorry about the filter, the mu.nu domain gets spammed a lot, so the filter has gotten touchy)

For starters - the question of "consensus" in intelligence briefs is not quite how you seem to think it is. Consensus opinions are a lot closer to votes in the Senate than anything else. Generally speaking, it's a preponderance of and so on. But all of this misses the fundamental point in question, so let's tackle it from a different angle.

Is it possible for a nation to disarm?

Yes. But more importantly, is it possible for a nation to show they've disarmed? Again, yes.

So what was deal here? The important qualifier is that for a nation to demonstrate that it has disarmed, it must be a willing participant. For example, South Africa shucked its entire nuclear weapons programs as well as all of its actual nukes. Point of interest is that South Africa sent a delegation to Iraq prior to the war to give them guidance on demonstrating how one is compliant with an inspection regime.

The other side of that, is that a nation that is not intent on disarmament, or is acting dishonestly can get away with garbage almost indefinitely. So, when it comes down to cases, if you've disarmed, it's your responsibility to demonstrate it - the obligation does not rest on the external observer. Inspection teams are their to inspect facitlities and records - not to play detective.

Now to broaden this out a bit to Iraq, we know that he had weapons programs post-1991 Gulf War. We now find no such programs in Iraq. When, exactly did that change? We don't know. We have no earthly idea. To assert that the administration distorted the intelligence is to argue that, presumably some time under Clinton, back when we still thought he had a program, he magically up and shucked his program - and then didn't tell anyone, and moreover refused to take the steps needed to demonstrate that. That flat out doesn't make any sense.

But getting back to the first point, is that containment regimes are never static. In this particular case, it doesn't take a lot of looking to discover that the "containment box" we put Saddam in was beginning to leak all over creation, and wouldn't have made it another 4-5 years. At which point, then inspection regimes become worthless.

So, we have a guy who did/does/would have had WMD reconstituted programs, and rather shortly would have had weapons (nb - don't be misled by the conflation of statements about the nuclear program with broader statements about his WMD programs).

Now, going back to the original argument, we also have a delivery system, in the form of globalized terrorist networks.

The question then becomes one of how you address the problem. Well, to begin with, we can see that status quo ante did not work (viz. 9/11). Secondly, we can't rely on getting sufficient intel to prevent an attack by terrorists using WMD. Third, we can't rely on a traditional deterrence framework to prevent such an attack.

To these dilemmas, you suggest a police action rather than a war. So, amongst other things, what do you consider a "police action"? And, given that we weren't able to even enforce extant UN resolutions on Iraq for any length of time, what do you think the odds of making such a police action effective would be?

Quick response, as I've been real busy as of late.

As to consensus, there may or may not have been "consensus" wrt Iraq. The issue is that, before you decide to overtoppled a regime using WMDs as a reason for the war, you should be extremely extremely confident that they have WMDs. And the intelligence community had no evidence that he had WMDs, just conjecture. Without evidence, you can't start a war. You can push for inspections, and use the threat of military action to give inspections some teeth. But if you start a war, and are wrong, there are serious problems.

As for disarmament, I am fine with using the threat of military action to add teeth to open countries up to inspection, as was successfully done in Iraq in the lead up to the war. Or military action to take out known WMD sites (think Desert Fox). For dealing states with WMDs, that's a fine strategy.

For terrorism, a state-based solution will only work if that state is behind that terrorism. Afghanistan, for example, is a very good example. Iraq is not. Police action would be intelligence, undercover work, etc. in order to find terrorist cells, infiltrate their networks, and find them. In fighting terrorists (which are often state-less), police action makes much more sense than war against a state that is tangentially related to terrorism.

As for containment, containment can work and had worked for the last 6-7 years. The fact that Hussein had no WMDs when we attacked showed that containment did work. By simple things like no-fly zones and the threat of preemptive attacks on specific weapons sites. In the case of Iraq, the status quo did work (as Iraq had nothing to do with 9/11). Solutions to stop terrorism should focus on stopping terrorism (police action, for example), and not by attacking already neutered states with minimal/no ties to terrorism.

No worries about the late thing - it seems to have taken us down a more interesting discussion about basic principles, rather than getting stuck on data interpretation.

First off, rather than going go back and forth about nine hundred times on consensus and confidence in data and the effectiveness of intelligence analysis over all, let's mook over to a more interesting point. Ok, so you're saying that the penalty for a false positive result in this case (i.e. Iraq has capability X, Y, Z) is quite high, and should therefore be avoided. I agree, conceptually. My question to you is what happens when you get a false negative with a country like Iraq?

I think you (and others) set up a false dilemma here. It is entirely possible to do all the cloak and dagger stuff and still have a visible military effort. All things considered, however, our brilliant success in finding Eric Rudolph and Ted Kaczsinski, combined with our history with human intelligence doesn't inspire me with a great deal of confidence in the notion that all of this alone is sufficient. Going back to a much earlier point, is that knowing that you will never get all of the bad guys, and knowing that they aren't easily deterred, what are the implications, especially if they are able to obtain WMD?

As far as it goes, sanctions didn't work. There's a touching faith in sanctions in the policy community, but basically sanctions generally work only against nations that actually care what we think about them. Sanctions against Britain would be of enormous importance. Sanctions against Cuba, well. It's also worth noting the humanitarian campagin to end the Iraq sanctions and the whole Smart Sanctions deal in 2001.

At any rate, riddle me this. We know at one point Iraq had WMD. Based on our information and intelligence we continued to believe that Iraq had WMD through The Clinton Presidency - hence Operation Desert Fox. Now magically, at some point between then and now, Iraq just up and got rid of their entire arsenal in secret and then failed to document it. How, when, and what the hell was the logic there?

Just as a quick aside, you probably want to avoid using that particular construction. I think what you're shooting for is closer to "states which weren't particularly strong state supporters of terrorism". Otherwise, the statement is debatable at the least and even in that case veers off into the semantic ether.

To recap. We aren't (and never have been) really good at intel stuff. Not only are we pretty shaky, we know we're pretty shaky. Now you've got folks with WMD. You've got folks who are big mass-casualty-terrorist-attack fans.

And you want to really let prevention of the collusion of these things rely on the intel agencies that have missed the boat so significantly in the past. Consider the warning left by Irish terrorists as they attempted to assassinate Maggie Thatcher "We have to be lucky only once, you have to be lucky every time."

9/11 they were lucky once. They will, in all likelyhood, be lucky again. How do you want to stack the odds?

The penalty for a false negative? It ranges from nothing to potentially high. I'm not saying that Hussein should be allowed to have WMDs (and neither was the rest of the world). I'm saying that active inspections is a very good deterrent from having WMDs and using WMDs. The cost of active inspections (in money, lives, geopolitical stability) is much less than the cost of deposing Hussein (tons of money, tens of thousands of lives, a nation in a low-grade civil war, possibly giving Iranian extremists power via Shiite control, etc).

If the cost of deposing any dictator is minimal, then I'm all for it (WMDs or not). For example, taking out Kim Jong-Il would be great. But there are serious costs that are involved (e.g. the possible destruction of Seoul). In these situations, a cost-benefit analysis needs to be taken. And the WMD-specific benefits of taking out Hussein (eliminating a ruler that may have WMDs, but ends up not having them; which may give these WMDs to rogue agents, even though there's no evidence of any actions like this ever being undertaken or planned) are nowhere near the costs involved (a few listed in the previous paragraph).

Again, it's a cost-benefit anaylsis. In the case of Afghanistan, it made sense (mainly because it was a state actively involved in supporting terrorism). In Iraq, it doesn't.
